I agree; I don't think anything needs to change because the user takes a "clear affirmative action" to subscribe:
many lists allow posting without being subscribed...
In which case the "clear affirmative action" is the sending of the email to the mailing-list.
If services feel the need to spell things out an auto-responder can reply with the necessary notices.
